Terms of Service and Data Licence

Effective date: October 26, 2026

Who we are and what these terms cover

These terms are an agreement between you and Stateful Partners (“we”, “us”). They cover the website at pullerdata.com, the Puller API at api.pullerdata.com, our data files, and any data, documents or support we provide (together, the “Service”). “Data” means any record, field, score or file you receive from the Service.

If you use the Service for a company or other organisation, you accept these terms for it, and you confirm you have the authority to do so. “You” then means that organisation.

How you accept these terms

You accept these terms when you do any of these things:

  • tick “I agree to the Terms of Service” on a form on our website;
  • receive or use an API key or a data file from us;
  • use the Service in any other way.

If you do not agree, do not use the Service.

If you sign a separate written agreement with us, that agreement wins where it conflicts with these terms.

The data and where it comes from

The Data is compiled from public government records. These include building permits, inspections and fees from cities and counties, parcel and owner records from County Assessors and county appraisal districts, and contractor licence and discipline records from the Nevada State Contractors Board and the Texas Department of Licensing and Regulation. Some records name people, such as property owners, applicants and contractors, and give their addresses, phone numbers and email addresses.

We do not create these records. Agencies do. We collect, clean, join and enrich them.

Your licence

We grant you a licence to use the Data. The licence is:

  • non-exclusive;
  • non-transferable, and you may not sublicense it;
  • revocable by us at any time;
  • for your internal business use only;
  • limited to the regions, volumes and period we agree with you.

You do not need to credit us or Puller when you use the Data.

We and our licensors keep all other rights in the Service and the Data as compiled, including the selection, arrangement, enrichment, scores and documentation. Nothing in these terms transfers ownership to you. This does not limit any right you have in the underlying public records themselves.

What you may not do with the Data

You may not:

  • sell, resell, license, publish, share or redistribute the Data, or any substantial part of it, in raw or lightly changed form, to anyone outside your organisation;
  • use the Data to build, train, improve or supply a dataset, product or service that competes with the Service;
  • give access to the Service to anyone outside your organisation, except your contractors working only for you under duties at least as strict as these terms;
  • scrape, copy in bulk or harvest the Service other than through the API as documented;
  • get around rate limits, access controls or other technical limits;
  • reverse engineer the Service, except where the law allows it despite this term;
  • remove or change any notice we include with the Data;
  • use the Service in a way that harms it, us or others.

Not a consumer report: prohibited uses

We are not a consumer reporting agency. The Data is not a “consumer report” under the federal Fair Credit Reporting Act (FCRA) or any similar state law. We have not built the Service to meet the duties those laws place on consumer reporting agencies.

You must not use the Data, in whole or in part, as a factor in deciding whether an individual is eligible for:

  • credit or a loan;
  • insurance, including underwriting or pricing insurance for an individual;
  • employment, promotion or retention;
  • renting or buying housing, including tenant screening;
  • any licence or government benefit;
  • any other purpose listed in section 604 of the FCRA or a similar state law.

You must not use the Data to locate, track, harass, threaten, stalk or intimidate any person named in it, or to discriminate unlawfully against anyone.

Marketing and outreach

If you use the Data to contact anyone, you alone must comply with every law that applies to that contact. These include the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule and the National Do Not Call Registry, the CAN-SPAM Act, and state laws on calls, texts, email, mail and solicitation. You must get any consent those laws require, honour opt-outs, and scrub against do-not-call lists. The Data includes no consent to be contacted.

Your duty to comply with the law

You are responsible for making sure your use of the Data is lawful. This includes privacy, data protection, anti-discrimination, consumer protection and marketing laws in every place where you use the Data or where the people in it live. We do not give you legal advice about your use.

If a person asks us to correct their record or leave their name out of future deliveries and we agree, or the law requires it, we may tell you. You must then update or delete that record in your copies within 30 days.

API keys

We issue API keys by hand after a request. You must:

  • keep your keys secret and never put them in public code, a browser app or a shared file;
  • tell us at once at contact@statefulpartners.com if you think a key has been exposed or misused.

You are responsible for all use of your keys, whether or not you authorised it, until you tell us of a problem and we have had a reasonable time to disable the key.

We set rate limits and usage limits, and we may change them. We may suspend or revoke any key at any time, with or without notice, including when we suspect misuse, a breach of these terms, a security risk, or unpaid fees.

The contractor conduct score

We may deliver a 0 to 100 contractor conduct score. The score is our opinion. It is derived by a documented method from public records, such as permits, inspections, licence status and discipline. It is not a statement of fact about any contractor, their work, their honesty or their fitness. It is not a rating of any individual’s creditworthiness, character or reputation, and you must not use it for any purpose listed in “Not a consumer report: prohibited uses”. You should verify any fact that matters to you with the source agency, such as the Nevada State Contractors Board.

Fees

Fees are agreed with each customer. Unless we agree otherwise in writing, fees are due in advance, are not refundable, and do not include taxes, which you pay. We may suspend the Service if fees are overdue.

Data provided “as is”

THE DATA COMES FROM PUBLIC SOURCES THAT MAY BE WRONG, INCOMPLETE, LATE OR CHANGED. WE PROVIDE THE SERVICE AND THE DATA “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS.

TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY. THIS INCLUDES ANY WARRANTY OF ACCURACY, COMPLETENESS, TIMELINESS, CURRENCY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT ANY REGION OR FIELD WILL STAY AVAILABLE, OR THAT THE DATA MATCHES THE AGENCY’S CURRENT RECORDS. MATCHES BETWEEN RECORDS (FOR EXAMPLE, A PERMIT TO A CONTRACTOR OR A PARCEL) AND DERIVED FIELDS, TAGS AND SCORES ARE MADE BY AUTOMATED METHODS AND MAY BE WRONG. YOU USE THE DATA AT YOUR OWN RISK AND SHOULD CHECK IT BEFORE RELYING ON IT.

Limits on our liability

TO THE FULLEST EXTENT THE LAW ALLOWS:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL OR DATA, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
  • OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE, THE DATA OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE FEES YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) US$100 IF YOU PAID US NOTHING IN THAT PERIOD.

THESE LIMITS APPLY TO ANY THEORY OF LIABILITY, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY AND STATUTE. THEY APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME PLACES DO NOT ALLOW SOME OF THESE LIMITS; THERE, THEY APPLY AS FAR AS THE LAW ALLOWS.

Your indemnity

You will defend, indemnify and hold harmless Stateful Partners, its owners, officers, employees and contractors from and against any claim, demand, fine, penalty, loss, damage, cost and expense (including reasonable legal fees) arising from or relating to:

  • your use of the Service or the Data, or use by anyone using your keys;
  • your breach of these terms;
  • your breach of any law, including the FCRA, TCPA, CAN-SPAM and privacy laws;
  • any claim by a person named in the Data, or by a regulator, about your use of the Data.

We may take part in the defence with our own counsel at our own cost. You may not settle a claim that imposes any duty or admission on us without our written consent.

Changes to the Service

We may add, change, suspend or stop any part of the Service at any time, including regions, fields, formats, endpoints and limits. Agencies may stop publishing a record or change it, and we may have to drop it. We will try to give notice of a major change, but we do not have to.

Changes to these terms

We may change these terms by posting a new version on our website with a new effective date. The new version applies from that date. If you keep using the Service after that, you accept it. If you do not agree, stop using the Service.

Termination

Either of us may end your use of the Service at any time, for any reason, with or without notice. We may also suspend it at any time.

When your use ends, your licence ends. You must stop using the Data and delete it, and any copies, within 30 days, unless we agree otherwise in writing or the law requires you to keep it. On request, you will confirm in writing that you have done so.

These sections survive the end of your use: what you may not do with the Data, prohibited uses, marketing and outreach, your duty to comply with the law, fees owed, data provided “as is”, limits on our liability, your indemnity, feedback, disputes, and general terms.

Feedback

If you send us ideas, suggestions or other feedback about the Service, we may use it for any purpose, without payment or credit to you. You grant us a perpetual, irrevocable, worldwide, royalty-free licence to do so.

Disputes: binding individual arbitration

Please read this section carefully. It affects your rights.

Arbitration. Any dispute, claim or controversy between you and us arising from or relating to the Service, the Data or these terms (a “Dispute”) will be resolved by final and binding arbitration. The American Arbitration Association (AAA) will administer it under its Commercial Arbitration Rules then in force. A single arbitrator will decide the Dispute. The arbitrator may hold hearings by video or telephone. The arbitrator’s award may be entered as a judgment in any court with jurisdiction. The Federal Arbitration Act governs this section.

Class-action waiver. You and we may bring claims against each other only in an individual capacity. Neither of us may bring or take part in a class, collective, consolidated or representative action or arbitration. The arbitrator may not consolidate claims of more than one party or preside over any form of class or representative proceeding. If this waiver is found unenforceable for any claim, that claim must be severed and heard in a court, and it may not proceed in arbitration.

Jury waiver. If a Dispute goes to court for any reason, you and we waive any right to a jury trial, to the extent the law allows.

Exceptions. Either of us may seek a temporary or permanent injunction, or other equitable relief, from any court with jurisdiction to stop actual or threatened misuse of the Service, the Data, API keys or intellectual property. Doing so does not waive the right to arbitrate other matters.

Time limit. To the extent the law allows, you must start any Dispute within one year after it arises, or it is permanently barred.

Confidentiality. The arbitration and its outcome are confidential, except as needed to enforce the award or as the law requires.

General terms

Entire agreement. These terms, our Privacy Policy, and any written order or agreement we sign with you are the whole agreement between us about the Service. They replace any earlier understanding.

Severability. If any part of these terms is found invalid or unenforceable, it will be enforced as far as possible, and the rest stays in effect.

No waiver. If we do not enforce a term, we have not waived it.

Assignment. You may not assign or transfer these terms, or any right or duty under them, without our written consent. Any attempt to do so is void. We may assign or transfer these terms at any time, including in a merger, sale of assets or reorganisation.

No third-party beneficiaries. These terms are for you and us only. No one else, including any person named in the Data, has any right to enforce them.

Independent parties. Nothing in these terms makes us partners, agents or employees of each other.

Events outside our control. We are not liable for any delay or failure caused by events beyond our reasonable control, including the outage, change or withdrawal of an agency’s source.

Notices. We may send notices to the email address you gave us, or post them on our website. You must send notices to contact@statefulpartners.com.
